Eminent Domain Subcommittee
Overview
The Eminent Domain Subcommittee will focus its attention on one aspect of real estate litigation - eminent domain and takings law. There has been a steady stream of U.S. Supreme Court opinions that have addressed or relied on this area of law, even when deciding cases that did not originate as direct eminent domain actions. Recent subjects have included legislative and administrative exactions, unconstitutional conditions, exhaustion of state remedies, the right to exclude others from your property, and more. Issues surrounding private property rights are fundamental to the entire field of real estate law, and this Subcommittee will focus on the intersection where private property rights meet (or get met by) the sovereign’s power of eminent domain. The Subcommittee will publish and present on topics of interest to the ACREL Fellows, and it will provide a forum for an open discussion on current events and topics of interest to the members of the Subcommittee in periodic virtual meetings. All are welcome to join even if they do not regularly practice in this area of law.
